Consumer Protection Notice No. 2 of 2015

Safety warning notice to public

Pursuant to paragraphs 129(1)(a) and 129(1)(b) of Schedule 2 of the Competition and Consumer Act 2010, I, BRUCE BILLSON, Minister for Small Business:

(a) state that the consumer goods specified below are under investigation to determine whether those goods will or may cause injury to any person, or a reasonably foreseeable use (including a misuse) of those goods, will or may cause injury to any person; and

(b) warn of possible risks involved in the use of those goods.

Particulars of goods

M Spa Inflatable Spas supplied with a with a 240V control box manufactured by Oriental Recreational Products (Shanghai) Co. Ltd, a heater and an air blower.

The goods are known variously as:

  • Bubble Silver Cloud Inflatable Spa
  • Lite Silver Cloud Outdoor Inflatable Spa
  • Nest 2 Person Inflatable Spa
  • Alpine Spa
  • Camaro Spa
  • Tuscany Spa.

Investigation

The Australian Competition and Consumer Commission and Australian electrical regulators are investigating whether MSPA Inflatable Spas, which have been sold in Australia since September 2012, will or may cause injury to any person, or a reasonably foreseeable use (including a misuse) of those goods will or may cause injury to any person, following reports of electric shock within Australia and Europe.

The spas are supplied in Australia by at least 10 suppliers, including as ‘give away’ promotions.  Voluntary recalls have been received from five suppliers.

Possible risks

There is a risk of electrocution to consumers using M Spa Inflatable Spas due to a failure of insulation between a live part of the heating element and its metallic enclosure. The water circulates through the metallic enclosure which means a failure of the insulation will make the water live.

Advice to consumers

Inspect any inflatable spa purchased since September 2012

Which spas are affected?

  • Double insulated M Spa Inflatable bubble spas with control boxes marked with the symbol Inflatable spa warning notice - symbol  and contain the approval number SAA121805EA or SAA121806EA
  • Those with approval number SAA121805EA
    • have serial numbers of control boxes which start with LGBAU
    • are supplied with a built-in control box.
  • Those with approval number SAA121806EA
    • have serial numbers which start with 2G3BAU
    • are supplied with an external or a built-in control box.
  • Spas with an external control box have the electrical information labels printed on the protective cover of the control box.
  • Spas with a built-in control box have the electrical information labels printed on the spa liner.

What consumers should do?

  • Stop using the spa immediately. Unplug it from the socket outlet.
  • Disconnect the control box and check for the following information on the protective cover of the control box or on the spa liner.
  • Examples of the rating labels are shown below and include the brand name, model number, double insulation symbol  Inflatable spa warning notice - symbol, serial number, approval number and the supplier name.

  • Identify whether a voluntary recall is in place by visiting www.recalls.gov.au. If a voluntary recall is in place contact your supplier. If a voluntary recall is not in place email the ACCC at productsafety@accc.gov.au or call the ACCC Infocentre on 1300 302 502 Mon-Fri 8:30am – 8pm.
